Delta 9 became federally legal in the United States upon passing Farm Bill 2018. But only a few state laws immediately responded to its legal implications, pending the conflicts in its safety and social impact. Hemp and its derivative products are finally legal in Tennessee but with certain considerations. It applies in the production, sale, purchase, and use of Delta 9. The amendment was contained in Senate Bill 357 and House Bill 1164. 

What Is Delta 9?

Delta 9 or Delta 9 THC (tetrahydrocannabinol) is a chemical compound or cannabinoid that can be extracted from hemp. In the past, THC was referred to as “weed” because it was mainly associated with marijuana. This association is also what put the confusion and hesitation of the lawmakers in drafting their regulations. 

But after further studies, it was proven that THC could also be derived from hemp. Hemp is a type of cannabis plant with a THC content lesser than 0.3% by dry weight. Its action primarily focuses on minimizing brain activity to relieve insomnia, poor appetite, and pain. THC may cause euphoria, but its effect is minimal as long as it is taken in moderation. 

How Is Delta 9 Legal in Tennessee?

The 2018 Farm Bill addressed the decade-long issue of the legality of cannabis. For many years, the federal government had no clear differentiation between hemp and cannabis. Both compounds were considered illegal and listed under the Controlled Substances Act (CSA). 

After thorough research, the Farm Bill amended the CSA, separated hemp from marijuana, and legalized it. Marijuana, however, remained illegal across the States, as well as the Cannabis sativa strains with THC over the legal threshold. The US Department of Agriculture now recognizes hemp as a common commodity. But, its federal legalization does not mean simultaneous amendment of individual state laws. 

By the end of 2019, Tennessee passed Public Chapter 916, amending Public Chapter 87, which was rewritten in September 2021. 

Delta 9 is legal in Tennessee, but only when it passes the following conditions:

  • The product is derived from hemp.
  • The THC content must not exceed 0.3% by dry weight.

Is Delta 9 legal in Tennessee without prejudice to the number of products you can own?
